www.kza.fr (the “Site”) is published by the company SAGAMORE KZA, EURL with capital of €5,000, whose registered office is located at 20 ter rue Lejeune – 31 000 Toulouse, France, registered with the Toulouse Trade and Companies Register under number 832 260 194.

The site is the property of the company SAGAMORE KZA, which exclusively uses the registered Kza trademark in its entirety, as well as all related rights.
All rights of reproduction, in whole or in part, are reserved, including photographic representations. Reproduction of all or part of this site, on any medium whatsoever, is strictly prohibited without the express authorization of the publication manager.


ACCEPTANCE OF TERMS
The customer acknowledges having read, at the time of placing the order, the specific conditions of sale stated on this screen and expressly declares to accept them without reservation.

These general terms and conditions of sale govern the contractual relationship between Kza.fr and its customer, and both parties accept them without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions contained in any other document, unless otherwise expressly agreed in writing.


PRODUCTS
The photographs illustrating the products are not contractually binding. If errors appear in them, Kza cannot be held liable under any circumstances. Our product offers are valid as long as they appear on our website and while stocks last. If, despite our vigilance, a product proves unavailable, we will contact you by telephone or email to modify or cancel your order as soon as possible.



ORDER
When placing their first order, the customer must provide their personal contact information, which is necessary for invoicing and delivery of the products. Automatic registration systems are considered proof of the nature, content, and date of the order. Kza.fr confirms acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded once the order has been confirmed. Kza.fr reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The information provided by the buyer when placing the order is binding on the buyer: in the event of an error in the recipient's contact information, the seller cannot be held responsible for any inability to deliver the product.

DELIVERY
We ship packages via La Poste's Colissimo service.
If you would like a delivery address different from the one on your account (for example, for a gift), you can specify it when confirming your order.

The shipping costs are as follows:

Metropolitan France and Corsica: €6.90. Shipping is free for purchases over €95.

French Overseas Territories, European Union*, Norway and Switzerland: €15

International: €29

*European Union countries: Germany, Austria, Belgium, Bulgaria, Cyprus, Denmark, Spain, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Slovakia, Slovenia, Sweden.
*Overseas Territories: Guadeloupe, Martinique, Guyana, Reunion, New Caledonia, French Polynesia, Wallis and Futuna.

DELIVERY TIMES
The deadlines are given for information purposes only according to the Colissimo scales .

France: 24 to 48 hours on working days

European Union*, England and Switzerland: 2 to 4 working days

DOM-TOM: 5 to 7 working days

International: 5 to 7 working days

Your order will be delivered to the delivery address indicated on the order form. If you are not there at the time of delivery, a delivery notice will be left for you to collect your package from the nearest post office. Packages will be held at the Post Office for 15 calendar days. Proof of identity is required to collect your package. If the package is not collected within the time limit set by the carrier, the products will be returned to Kza.


For all orders placed before 1 p.m., packages will be sent the same day, otherwise packages will be sent the next day.

As soon as the shipment is made, you will be immediately notified by email and you will be able to track your postal packages with a number.

All orders placed are for the personal use of customers; customers or recipients of the products are prohibited from any partial or total resale of the products. Kza therefore disclaims any legal liability if the customer does not pay the taxes. In the event of apparent defects, the buyer has the right to return the product under the conditions set out in this document.

War, riots, fire, strikes, accidents, and the impossibility of obtaining supplies are considered force majeure events that relieve the seller of their obligation to deliver. Goods always travel at the recipient's risk. Always check your package upon arrival.

PRICE
The price is expressed in euros.

The price indicated on the product sheets does not include transport.

The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and the countries of the European Union.
For products shipped outside the EU and/or French overseas departments and territories, the price is automatically calculated excluding taxes on the invoice.
Customs duties or other local taxes, import duties, or state taxes may be payable in certain cases. These duties and amounts are not the responsibility of the seller. They will be borne by the buyer and are their responsibility (declarations, payment to the relevant authorities, etc.). The seller therefore invites the customer to inquire about these aspects with the relevant local authorities.

SECURE PAYMENT
The price charged to the customer is the price indicated on the order confirmation sent by Kza.

The price of the products is payable in cash on the day of the actual order, including for pre-ordered products.

Payment can be made in the following ways:
* Bank cards: Visa, Mastercard, Maestro
For the security of your payments, we use E-Transactions, the bank card payment solution developed by our bank, Crédit Agricole.
With this system, your card payment is made directly on the secure server of our bank, Le Crédit Agricole, on our behalf. Your card number will never be shared with us. All transactions are encrypted and secured using the SSL 3 (Secure Socket Layer) protocol on the Internet, a protocol that has become a global standard and is usable by major browsers.
Crédit Agricole has implemented the 3D-Secure system, which improves transaction security. For you, greater security for your online payments. E-Transactions allows you to pay via a Crédit Agricole banking server in a secure environment. Your credit card number is therefore directed to the bank's servers, your payment is made directly to a bank in a secure environment without going through the store's server, a guarantee that is all the more important since your numbers are known only to our banking partner (Crédit Agricole).
The order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, Kza reserves the right to refuse any order from a customer with whom there is a dispute.

DISPUTES
This contract is subject to French law. Kza cannot be held liable for damages of any kind, whether material, immaterial, or physical, which may result from malfunction or misuse of the products sold. The same applies to any modifications to the products resulting from manufacturers. Kza's liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions which may have persisted despite all the precautions taken in the presentation of the products.

In the event of a dispute, the customer will contact the company as a priority to obtain an amicable solution.

Failing this, the Commercial Court of Toulouse shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.


LEGAL INFORMATION - CONFIDENTIALITY
The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, preparing invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act (Informatique et Libertés), the processing of personal information relating to customers has been declared to the French National Commission for Information Technology and Liberties (CNIL). The customer has (Article 34 of the Act of 6 January 1978) a right to access, modify, rectify and delete data concerning them, which they may exercise with Kza. In addition, Kza undertakes not to communicate, free of charge or with compensation, the contact details of its customers to a third party.


MANUFACTURING/QUALITY CONTROL
To guarantee the highest quality, Kza inspects its products at several stages of manufacturing. Upon arrival at our warehouses, we verify the good condition of our suppliers' products. If, despite our best efforts, a product proves defective, Kza undertakes to exchange it for an identical one as quickly as possible, while stocks last.

REFUND AND EXCHANGE

Warranty and after-sales service:
In all cases, Kza cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. Kza's liability is systematically limited to the value of the product in question, the value on its date of sale, without any possibility of recourse against the brand or the company producing the product.

Defective products or size problems or errors in orders:

Any complaint regarding an order must be made to our customer service by email at kzainfo@kza.fr within a maximum of 48 hours after receipt of the goods. Any claims or exchange requests made after this period will be refused.

Kza undertakes to exchange any defective product for an identical one as quickly as possible, subject to available stocks.
In the event of unavailability of the said item, Kza undertakes to offer a similar product, a credit note or a refund.


RIGHT OF WITHDRAWAL AND RETURN

1. You have the right to terminate the contract concluded with Kza, without any penalty and without specifying the reason, within 14 (fourteen) days from the day of receipt of the products purchased on www.kza.fr.

2. To terminate the contract, please send us an email to kzainfo@kza.fr by indicating your invoice number, the details of the products you wish to return and, if you wish, the reason for this return.

3. The right of return - in addition to compliance with the deadlines and procedures described in the previous points, is considered to be correctly applied in the event that the conditions presented in our general conditions of sale are fully respected:

a). the product must not have been worn, worn, altered, washed or damaged;
b). the label must still be attached to the product;
c). the product must be returned in its original packaging;
d). Returned products must be sent to Kza in a single shipment, to the following address:

In the event that the terms and conditions for exercising the right of withdrawal have not been respected, as specified in paragraph 3, you will not be entitled to a refund of the amounts already paid to Kza: however, you may re-obtain, at your expense, the products in the condition in which they were returned to Kza. Otherwise, Kza may retain the products, in addition to the amounts already paid for their acquisition.

Reimbursement deadlines and terms:

Regardless of the payment method you used, the refund is activated by Kza within 30 (thirty) working days from the date on which Kza was notified of the exercise of the right of withdrawal, once verification has been made of the correct execution of your right of withdrawal and acceptance of the returned products.
